1. Acceptance of Terms
These Terms and Conditions (“Terms”) govern your access to and use of the website located at www.leancarehealth.com (the “Site”), operated by Leancare Health & Wellness (“Leancare,” “we,” “us,” or “our”), located at 3002 Myrtle Ave N, Suite 1, Jacksonville, FL 32209. By accessing or using the Site, submitting an appointment request, completing an online screener, or otherwise interacting with our services, you agree to be bound by these Terms. If you do not agree, do not use the Site.
These Terms apply to the Site and its general content only. Your clinical care is governed separately by the informed consent forms, HIPAA authorizations, and patient agreements you sign in person or through our patient portal at the time services are actually provided.
2. No Doctor-Patient Relationship From Site Use
Browsing this Site, reading blog content, submitting an appointment request, or completing an online screener does not create a doctor-patient, provider-patient, or other clinical relationship between you and Leancare or any of its providers. A provider-patient relationship is established only when you have an actual visit (in-person or telehealth) with a Leancare provider and that provider agrees to treat you.
3. Not Medical Advice — Educational Content Only
All content on this Site, including blog articles (e.g., discussions of arthritis, HPV/cervical cancer, weight management, walking pneumonia, and similar topics), service descriptions, and general wellness information, is provided for general educational and informational purposes only. It is not intended to be, and should not be relied upon as, medical advice, diagnosis, or treatment. It is not a substitute for professional medical judgment obtained through an actual visit with a qualified healthcare provider.
Always seek the advice of a physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay seeking it because of something you read on this Site.
4. Emergency Disclaimer
This Site, our online screeners, and our appointment request form are not monitored continuously and are not intended for urgent or emergency use.
- If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately.
- If you are experiencing a mental health crisis, suicidal thoughts, or severe withdrawal symptoms, call or text the Suicide & Crisis Lifeline at 988, or go to the nearest emergency room immediately.
- Do not use the appointment request form, email, or online screeners to communicate urgent symptoms. These channels are not reviewed in real time.
5. Appointment Requests
Submitting the appointment request form is a request only — it is not a confirmed appointment, and no clinical relationship is formed until our team contacts you and a visit is scheduled and completed. We aim to respond within one business day, but response times are not guaranteed.
Do not submit sensitive personal health information (including but not limited to details of specific symptoms, diagnoses, medications, or mental health history) through the appointment request form. Use of this form is at your own risk with respect to information you choose to submit, and while we apply reasonable safeguards, standard web contact forms are not equivalent to our HIPAA-secured patient portal.
By providing your phone number and email and opting in to communications, you consent to receive appointment-related calls, texts, and emails from Leancare, and, if you separately opt in, occasional wellness tips and practice updates. Message and data rates may apply. You may withdraw consent to marketing communications at any time using the unsubscribe instructions provided or by contacting us directly; this will not affect appointment-related or treatment-related communications necessary to provide your care.
6. Telehealth Services
Telehealth visits are provided in accordance with applicable Florida law and the standards of care applicable to in-person visits, to the extent reasonably possible in a virtual format. By requesting or participating in a telehealth visit, you acknowledge and agree that:
- Telehealth has inherent limitations compared to an in-person examination (e.g., no hands-on physical exam), and your provider may determine that an in-person visit, referral, or emergency care is necessary.
- Technical failures (dropped connections, audio/video quality, etc.) may occasionally interrupt or delay care.
- Prescriptions issued via telehealth are subject to Florida telehealth prescribing laws, including restrictions on certain controlled substances.
- You must be physically located in a state where our providers are licensed to practice at the time of your telehealth visit. It is your responsibility to confirm this before booking.
- Telehealth communications are conducted through HIPAA-compliant, encrypted platforms, but no electronic transmission can be guaranteed 100% secure.
A separate, more detailed Telehealth Informed Consent form is provided and must be signed prior to your first telehealth visit.
7. Behavioral Health & Wellness Screeners
Online screeners (including the Anxiety Screener (GAD-7), Depression Screener (PHQ-9), and Wellness & Substance Screener (AUDIT-C/DAST-10)) are self-reported screening tools intended to help your provider prepare for your visit. They are:
- Not diagnostic tools and do not constitute a diagnosis, treatment, or clinical assessment on their own.
- Not monitored in real time and not appropriate for urgent or crisis situations (see Section 4).
- Reviewed by your provider only in connection with a scheduled visit.
Your screener responses are protected health information and are handled in accordance with our HIPAA Notice of Privacy Practices.
8. Weight Management Program
Our weight management program is physician-supervised and individualized. By enrolling, you acknowledge that:
- Results vary by individual and are not guaranteed. Testimonials and any before/after references reflect individual experiences and are not a promise of specific results for you.
- Any medications (including compounded medications) are prescribed only after clinical evaluation, are dispensed through licensed pharmacies, and are subject to your provider’s independent medical judgment. Compounded medications are not FDA-approved in the same manner as manufactured drug products, and availability, formulation, and coverage may change based on regulatory developments.
- Nutrition plans, meal plans, and body composition analysis are educational tools that supplement, not replace, your provider’s clinical guidance.
- You are responsible for disclosing your complete medical history, current medications, and any conditions relevant to weight management treatment.
9. Vitamin Injection Therapy
Vitamin B12, Lipotropic (MIC), and Immunity Boost injections are administered by trained clinical staff following a review of your relevant history by our team. These services:
- Are intended to address symptoms potentially associated with nutrient deficiency and general wellness support; they are not a treatment for any diagnosed medical condition unless specifically determined by your provider.
- Carry standard risks associated with injections (e.g., injection site reactions, allergic reactions). You will be asked to disclose allergies and relevant medical history before treatment.
- Are not guaranteed to produce any specific outcome.
10. Online Reviews and Testimonials
Patient reviews and testimonials displayed on the Site (including star ratings and quoted patient stories) reflect individual patient experiences and opinions. They are not a guarantee that you will have the same experience or outcome. Testimonials are used with patient permission.
11. Intellectual Property
All content on the Site, including text, graphics, logos, images, and the Leancare name and branding, is the property of Leancare Health & Wellness or its licensors and is protected by U.S. copyright and trademark law. You may not reproduce, distribute, modify, or create derivative works from Site content without our prior written consent, except for personal, non-commercial use.
12. Third-Party Links and Services
The Site may link to or integrate with third-party services, including our patient portal (healow), payment processors, and social media platforms (Facebook, Instagram, LinkedIn). We do not control and are not responsible for the content, privacy practices, or terms of third-party sites. Your use of those services is governed by their own terms and privacy policies.
13. Privacy and HIPAA
Our collection and use of your personal and health information is described in our Privacy Policy and, for protected health information, our HIPAA Notice of Privacy Practices. Both are available at our clinic and on request by contacting us at info@leancaresolutions.com. By using the Site and our services, you acknowledge that you have had the opportunity to review these policies.
14. Disclaimer of Warranties
The Site and its content are provided “as is” and “as available” without warranties of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Site will be uninterrupted, secure, or error-free. This disclaimer does not limit or affect the standard of care owed to you as an actual patient during a clinical visit, which is governed by Florida law and applicable professional standards, not by this section.
15. Limitation of Liability
To the fullest extent permitted by law, Leancare Health & Wellness, its owners, providers, employees, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Site or reliance on its general content. Nothing in this section is intended to, and shall not, limit liability for medical negligence or any claim arising from actual clinical care, which is governed by Florida medical malpractice law and cannot be waived through a website terms of use document.
16. Indemnification
You agree to indemnify and hold harmless Leancare Health & Wellness and its owners, providers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, violation of these Terms, or submission of false or misleading information.
17. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute arising out of or relating to your use of the Site (as distinct from clinical care disputes, which are separately governed by your patient agreements) shall be resolved exclusively in the state or federal courts located in Duval County, Florida, and you consent to the personal jurisdiction of those courts.
18. Children and Minors
The Site is not directed at children under 13. If you are under 18, you may use the Site only with the involvement of a parent or legal guardian, consistent with Florida law regarding minors’ consent to healthcare services.
19. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
20. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
